This guidance is applicable to debts, arising as a result of employment-cessation events, which are subject to the Occupational Pension Schemes (Employer Debt) Regulations 2005, as they existed before 6 April 2008.

As an employer you may be withdrawing from your multi-employer defined benefit occupational pension scheme, perhaps as a result of a corporate transaction, such as a sale of a subsidiary, or as a result of a review of your pension provision for your employees.

You may need to consider many questions…

  • Will you cease to employ active members of the multi-employer scheme and in doing so will you owe a debt to the scheme?
  • What are your options for withdrawing – will you pay the debt or enter into a withdrawal arrangement to pay a lesser debt?
  • Do you know what has to be included in a withdrawal arrangement, how much you need to pay, how much will be guaranteed, who can act as guarantor?
